These Terms of Use govern your use of www.3cits.co.za (the "website"), operated by 3cits (Pty) Ltd, trading as 3cits Consulting ("3cits", "we", "us"). Please read them carefully.
1. Acceptance
By accessing or using the website you agree to these terms. If you do not agree, please do not use the website. These terms are a data message under the Electronic Communications and Transactions Act 25 of 2002 (ECTA); you can save or print them for your records.
2. Information only, not professional advice
The content on the website is general information about 3cits and our services. It is not professional, technical, legal, financial or investment advice, and you should not act on it without getting advice that suits your situation.
- Using the website, or contacting us through it, does not create a client relationship. We provide services only under a separate written quotation, engagement letter or contract, and those terms apply to the services.
- 3cits is not an authorised financial services provider under the Financial Advisory and Intermediary Services Act 37 of 2002. Our startup support is limited to investor readiness (for example business plans, financial projections and pitch materials). We do not raise, invest or manage funds, and nothing on the website is an offer of securities or financial advice.
- In our consulting work 3cits is not a registered credit provider or debt counsellor under the National Credit Act 34 of 2005. Our fintech and debt management work is technology consulting and solutions delivery for businesses that hold the relevant registrations themselves.
3. Intellectual property
The website and its content, including text, graphics, logos, the "3cits" name and marks, layout and code, belong to 3cits or are used with permission, and are protected by copyright and other intellectual property laws. You may view the website, print or save pages for your own reference, and share links to it. You may not otherwise copy, reproduce, modify, distribute or commercially use any content without our prior written consent.
4. Acceptable use
You agree not to:
- use the website for any unlawful purpose or in breach of any applicable law, including the Cybercrimes Act 19 of 2020;
- attempt to gain unauthorised access to the website, its hosting or any related system, or interfere with its operation (for security research, see our Responsible Disclosure policy);
- introduce viruses, malware or other harmful code;
- overload the website with requests, or copy its content at scale by automated means;
- frame or mirror the website, or present it in a way that suggests an endorsement by or affiliation with 3cits that does not exist; or
- impersonate 3cits or any of our people.
5. Links to other websites
The website may contain links to websites run by others. We provide these for convenience only. We do not control and are not responsible for their content, availability or privacy practices, and a link is not an endorsement.
6. No warranties
We try to keep the website accurate and available, but we provide it "as is" and "as available". To the extent permitted by law, we make no warranties or representations, express or implied, that the website or its content is accurate, complete, current, uninterrupted, secure or free of errors, viruses or other harmful components.
7. Limitation of liability
To the extent permitted by law, including the Consumer Protection Act 68 of 2008 where it applies, 3cits, its director, employees and contractors will not be liable for any direct, indirect, special or consequential loss or damage of any kind arising from your use of, or inability to use, the website, or from reliance on its content, except where the loss is caused by our gross negligence or wilful misconduct.
Nothing in these terms limits or excludes any right you have, or any liability we have, that cannot lawfully be limited or excluded.
8. Indemnity
To the extent permitted by law, you indemnify 3cits against any claim, loss, damage or cost (including reasonable legal costs) arising from your breach of these terms or your unlawful use of the website.

Our Privacy Notice explains how we handle personal information, and our Cookie Notice explains the technologies the website uses.
10. Company information under ECTA
The information that section 43 of ECTA requires, including our full name, legal status, registration number, director, contact details and address, is on our Company Information page. No goods or services are sold and no payments are taken through the website; any services we provide are agreed in writing.
11. Electronic communications
When you email us, you agree to communicate electronically. A data message is regarded as received by us only when it enters our information system and is capable of being retrieved and processed by us (ECTA section 23). We are not bound by any agreement until we have confirmed it in writing.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any dispute arising from them or from your use of the website is subject to the jurisdiction of the South African courts.
13. Severability and waiver
If any provision of these terms is found to be invalid or unenforceable, it will be severed and the remaining provisions will continue in full force. If we do not enforce a right under these terms, that does not mean we have waived it.
14. Changes to these terms
We may update these terms from time to time by publishing a new version on this page. The date at the top of the page shows when they last changed. Your continued use of the website after a change means that you accept the updated terms.
